Terms and Conditions of Use
Each individual attending the Event must purchase a Ticket. In order to purchase a Ticket, you must fully complete the registration information form provided by Company. Tickets will be available for purchase until July 21, 2018, subject to availability and while supplies last.
Unless indicated otherwise, Ticket prices include all applicable taxes and/or fees (if any).
Terms of Ticket Sales
In order to be admitted to the Event, you must complete the registration information provided by Company and present the original Ticket in its original, undamaged, unaltered form, to us at the appropriate time and upon request. Entry may be refused for various reasons as set forth in the General Rules and Information below, including misconduct, intoxication, etc., as determined by Company in its sole discretion.
You and your belongings may be searched upon entry into the Event, and you consent to such searches and waive any related claims that might arise against Company in connection therewith. If you elect not to consent to these searches, you will be denied entry into the Event without refund or compensation to you.
You assume all risk or danger incidental to the Event, whether occurring prior to, during, or subsequent to, the Event.
Unused Tickets have no monetary value and cannot be credited to future years or events.
Cancellation of Event by Company
If the Event is cancelled by Company, you shall receive a full refund of the actual price paid for your Ticket. No partial or full refunds will be issued for any other reasons or circumstances.
Transfer, Resale and Promotional Use of Tickets Prohibited
Tickets to attend the Event are exclusive to each registered individual, are non-transferrable and may be revoked at any time for any reason. Transfer, attempted transfer, resale or attempted resale of any Ticket issued hereunder is prohibited, and is grounds for seizure and cancellation without refund or compensation to you.
The Ticket may not be used for any form of commercial or trade purposes, including, but not limited to, advertising, promotions, contests or sweepstakes.
Event admission is subject to venue capacity and age restrictions in compliance with state and local laws. Age restrictions are specific to each venue. Children under the age of 15 must at all times be accompanied by a parent or other adult guardian.
GENERAL RULES AND INFORMATION
By purchasing a Ticket and attending the Event, you agree to comply with all of the following:
· The Event will take place rain or shine, subject to prior cancellation by Company.
· All guests and attendees are expected to behave in a manner that is courteous to other attendees, all presenters, volunteers and exhibiters, comply with all of these General Rules and Information and all other rules communicated to you by the Company.
· All guests and attendees are subject to search upon entry.
· Surrendered items are considered forfeited on entry. No items will be returned, regardless of what any staff member tells you.
· Company is not responsible for any materials or belongings misplaced, lost or stolen. It is recommended that you do not bring valuable items. If you do bring valuable items, please bring security for these items.
· Feel free to bring your own food and non-alcoholic beverages to the Event; provided, no glass bottles shall be permitted.
· No glass containers of any kind, weapons (excluding simulated (prop) weapons accompanying a costume, subject to the below), knives (excluding simulated (prop) knives which accompany a costume), outside alcohol, non-prescription drugs, illicit drugs or drug paraphernalia will be allowed at the Event. For purposes of clarity, no functional weapons will be allowed.
· No open flames.
· No pets (excluding services animals) shall be allowed at the Event.
· No hover boards or motorized scooters.
· No smoking, including of E-cigarettes, shall be permitted within the Event facilities (“Event Facilities”). You are welcome to step outside the Event Facilities to smoke in designated smoking areas only, but please be considerate of others when you do.
· You also agree to comply with any and all additional rules and information communicated by Company.
· Simulated Weapons:
- All simulated weapons which accompany a costume must be examined by and registered with CoxCon personnel prior to entry to the Event.
- All costume props and weapons must conform to United States federal and United Kingdom law.
- Projectile costume props and weapons must be inoperable.
- Functional (real) arrows must have their tips removed and be zip-tied to a quiver.
- Costume swords must be tied to your costume in such a way that they can’t be drawn.
· Irresponsible use of alcohol
· Public nudity or obscene clothing
· Accessing restricted areas
· Taunting, abusive or disruptive language, obscene or offensive gestures, imagery or symbolism and/or behavior that is otherwise deemed offensive by the general public
The following actions will result in termination of the rights granted to you hereunder, revocation of your Ticket without prior notice, determination of your Ticket as void, ejection from the Event and determination that you are a trespasser at the Event
· Urinating in public (anywhere other than a proper restroom).
· Fighting or engaging in any action that may harm, endanger, threaten or bring discomfort to anyone.
· Harassing presenters.
· Engaging in sexual behavior in public.
· Possession/use/sale of illegal drugs.
· Damage, destruction, vandalism or theft of any property.
Authorization of Image and Likeness
You grant Company (and its affiliates, designees, licensees and assigns) the irrevocable right to film you at the Event and include your name, image, likeness, voice, actions, and statements in any live or recorded audio, video, film, webcast, stream, or other transmission, exhibition, distribution, simulcast, or reproduction made of, or at, or in connection with the Event and/or the Company (collectively, “Company Materials”) in any medium or context now known or hereafter devised for any purpose, including commercial or promotional purposes, without further authorization or otherwise, in perpetuity. The Company Materials shall constitute a “work made for hire” within the meaning of the United States copyright law, specially ordered or commissioned for use by Company. In the event any Company Material is deemed not to be a “work made for hire” under the United States copyright law, you hereby irrevocably grant, set over and assign to Company throughout the universe, exclusively and in perpetuity, all right, title and interest of every kind whatsoever, whether now known or unknown, in and to such Company Material.
You also agree to allow the Company, and its assignees or licensee to use the Company Material in connection not only with the Event, but also in any advertising, marketing or publicity for the Company and its affiliates, and in connection with any ancillary products associated with the Company, its affiliates and/or the Event, without compensation, except as prohibited by law.
You hereby irrevocably assign to Company (or irrevocably waive, in the event such assignment is not possible) any and all “moral rights” or similar law or rights. You hereby waive any right of inspection or approval of my appearance or the uses to which such appearance may be put. You acknowledge that Company will rely on the permissions granted herein and you hereby agree not to assert any claim of any nature whatsoever against anyone relating to the exercise of the permissions granted hereunder.
You understand that Company shall have no obligation to actually use the Company Materials.
Event’s Intellectual Property
Company owns the trademarks, imagery, name, likeness, and trade dress of the Event (collectively, the “Event Intellectual Property”) and does not permit the use of the Event Intellectual Property by you or by any third parties. You agree not to make use of the Event Intellectual Property except for nominative fair use or with prior written permission from the Company.
Recordings and Photography
You may bring personal, non-commercial, photography and video recording devices into the Event and may use these devices to obtain still photographs and video recordings (collectively “Event Photographs”).
Unless otherwise expressly agreed to in writing by the Company, you hereby grant to Company the non-exclusive, worldwide, perpetual right and license to exploit your Event Photographs by all means and in any media, including, without limitation, via reposting on to Company’s owned and operated social media channels and websites.
Reservation of Company’s Rights
Release of Liability, Disclaimer of Warranties and Limitation of Liability
YOU EXPRESSLY ASSUME ALL RISK AND DANGER ARISING FROM OR INCIDENTAL TO THE EVENT, WHETHER SUCH RISKS OCCUR PRIOR TO, DURING, OR SUBSEQUENT TO THE EVENT. YOU EXPRESSLY RELEASE THE EVENT FACILITY, MANAGEMENT, COX OMNI MEDIA EXPO LTD., VENDORS, PARTICIPANTS, PERFORMERS, THE TICKETING AGENCY AND/OR TICKETING SERVICES PROVIDER, SERVICE PROVIDERS AND THEIR RELATED ENTITIES AND ALL OF THEIR PARTNERS, AFFILIATES, SUBSIDIARIES, LICENSEES, ASSIGNS, AND ITS AND THEIR EMPLOYEES, OFFICERS, DIRECTORS, MEMBERS, SHAREHOLDERS, REPRESENTATIVES, CONTRACTORS AND AGENTS (collectively “COMPANY PARTIES”) FROM ANY AND ALL CLAIMS THAT YOU HAVE OR MAY HAVE THAT ARISE FROM OR ARE INCIDENTAL TO THE EVENT, INCLUDING ANY CLAIMS ARISING OUT OF THE NEGLIGENCE OF COMPANY PARTIES OR COMPANY PARTIES’ OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VENDORS, REPRESENTATIVES, OR AGENTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SAFETY, TITLE, AND NON-INFRINGEMENT, RELATED TO THE EVENT AND ANY AND ALL ELEMENTS AND ASPECTS THEREOF.
YOU UNDERSTAND AND AGREE THAT YOUR ATTENDANCE AT AND PARTICIPATION IN THE EVENT IS AT YOUR SOLE RISK. ALL EVENT PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. UNDER NO CIRCUMSTANCES, WILL ANY OF THE COMPANY PARTIES BE LIABLE TO YOU OR TO ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR ANY LOSS, INJURY, LIABILITY OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, INABILITY TO USE, OR RELIANCE ON ANY OF PRODUCT OR SERVICE PROVIDED TO YOU THROUGH OR IN CONNECTION WITH THE EVENT IN ANY MANNER OR NATURE WHATSOEVER. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND WHATSOEVER, WHETHER DIRECT OR INDIRECT, GENERAL, SPECIAL, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR OTHERWISE, INCLUDING WITHOUT LIMITATION, LOSS OF DATA, GOODWILL, REVENUE OR PROFITS. THIS LIMITATION OF LIABILITY APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR ANY OTHER BASIS; EVEN IF A COMPANY PARTY HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES; AND WITHOUT REGARD TO THE SUCCESS OR EFFECTIVENESS OF OTHER REMEDIES. IF ANY PART OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID, ILLEGAL OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF THE COMPANY PARTIES UNDER SUCH CIRCUMSTANCES TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE ABOVE DISCLAIMERS OF WARRANTIES AND LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.
IF THIS CLAUSE IS HELD TO BE UNENFORCEABLE IN WHOLE OR IN PART IN ANY JURISDICTION DUE TO RELEVANT LAWS, THEN IN NO EVENT SHALL COMPANY’S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT YOU HAVE PAID COMPANY DURING THE SIX (6) MONTHS PRIOR TO THE INCIDENT.
Governing Law/Dispute Resolution
You may provide information to us when you visit and/or use any of our online services or website located at https://www.coxcon.co.uk/ (“Site”) and/or when you purchase a Ticket for the Event (collectively with the Site, “Digital Services”).
Information Collection and Usage
We may collect personal and other information about you when you use any of the Digital Services and/or purchase Tickets for the Event, as described below. “Personal Information” is information which can be used to distinguish or trace an individual’s identity, such as their name, mailing address, email address, photograph, birth date, etc. whether used alone, or when combined with other personal or identifying information which is linked or linkable to a specific individual.
We typically collect Personal Information and other data from you, and use that information in the ways set forth below and as otherwise set forth in this Policy or otherwise communicated to you from time to time (subject to your consent when required by applicable laws). Please note, any information collected under this Policy may be associated with other information about you, whether by us or a third party service provider.

Making a Purchase
Our Digital Services may enable you to buy Tickets for the Event. Some purchases on our Digital Services are handled directly by the Company or its vendors and others are managed and processed by a third party service provider. We or third party service providers may collect Personal Information when you make purchases through our Digital Services, by telephone, or at the Event. If you are purchasing Tickets through third parties on our Digital Services, some or all of your purchase may be processed by a third party, Tickets may be issued and managed by that third party, and your Personal Information will be subject to the policies of that third party.
We or the third party service provider use purchase information in order to administer, manage and correspond with you about your purchase. You will also be subject to the terms and conditions of any third party service provider used by Company.
Automatic Collection When Accessing Digital Services
We may log click-stream or similar data for purposes of system administration, to improve our Digital Services, to report aggregate information to advertisers, and other uses related to the Digital Services. Click-stream data is information collected when you request pages from our Digital Services, and may include information such as the page served, the time, the source and type of browser making the request, the most recent page view, what you clicked on in order to arrive at our Site, and other non-Personal Information. This data helps us analyze how visitors arrive at our Digital Services, what type of content is most popular, what type of visitors are interested in particular kinds of events, content, advertising, and the like. We may associate click-stream, Ticket purchase (whether complete or incomplete) and other similar data with other information we hold about you so that we can personalize or improve the relevance and quality of the services or information provided.

Information we collect may be shared with a variety of parties, depending upon the purpose for and context in which that information was provided. We may, without your consent, share Personal Information and other data with service providers who provide certain services on our behalf, or in the other circumstances noted below. For example, we may share certain Personal Information we collect with third parties such as providers of data hosting or processing services, payment processors, or other service providers. In the event that we go through a business transition, such as a merger, acquisition, liquidation or sale of all or a portion of our assets, customer data, including Personal Information, will, in most instances, be part of the assets transferred, or may be disclosed (subject to confidentiality restrictions) during the due diligence process for a potential transaction.

It is possible for you to use some of our Digital Services without providing any Personal Information, but you may not be able to access certain features or view certain content. Please note, if you do not wish for us to provide certain information to one or more of our commercial service providers, we may be unable to complete a transaction you request or permit you to purchase a Ticket.
Updates and Access to Personal Information
You may access or update any Personal Information we hold about you by sending a letter or email using the contact information listed below. We will respond to reasonable requests for access or revision and will provide access to the extent required or allowed by law. However, we may decide not to grant access or make revisions where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in any given case, or when the rights of others would be violated by granting the access.

Furthermore, please remember that “perfect security” does not exist on the Internet, and accordingly we cannot provide any guarantee that your Personal Information or any other information you provide us will remain secure.
Guidelines for Minors
Our Digital Services are neither directed at nor intended for use by minors. Further, we do not knowingly collect Personal Information from minors. If we learn that we have inadvertently done so, we will promptly delete it. Do not access or use the Digital Services unless you are 18 years old or older or under the supervision of your parent or guardian.
Limitation of Liability
By providing us with any Personal Information you expressly and unconditionally release and hold harmless the Company Parties from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your collected Personal Information. In addition, we cannot be held liable for any injuries, loss or damage of any kind arising from or in connection with the use and/or misuse of your Personal Information by any third parties who receive your Personal Information. We make no representations or warranty regarding any third-party’s use, collection or disclosure of your Personal Information.
By using any of our Digital Services, you consent to the terms of this Policy. We may change this Policy from time to time. Your continued use of our Digital Services constitutes your acceptance of any revised Policy.
